La denuncia fue presentada por el jefe de los fiscales, Edmundo Jes\u00fas Jim\u00e9nez, al considerar que hubo una \u201ccampa\u00f1a de hostigamiento\u201d en su contra. La decisi\u00f3n judicial gener\u00f3 reacciones negativas de los sectores de prensa.<\/strong><\/em><\/p>\n<p>La\u00a0<strong>Justicia de\u00a0Tucum\u00e1n\u00a0dict\u00f3 como medida cautelar prohibir<\/strong>\u00a0al canal de televisi\u00f3n\u00a0<strong><em>Compa\u00f1\u00eda de Circuitos Cerrados S.A. (CCC)<\/em>\u00a0y a los trabajadores de dicha empresa realizar cr\u00edticas a jueces y fiscales<\/strong>. La decisi\u00f3n judicial\u00a0<strong>gener\u00f3 reacciones negativas\u00a0<\/strong>y la Asociaci\u00f3n de Prensa (APT) de esa provincia calific\u00f3 que el fallo constituye \u201cun atentado directo a la libertad de prensa y al derecho de la ciudadan\u00eda a estar informada\u201d.<\/p>\n<p>La resoluci\u00f3n, firmada por el juez subrogante\u00a0<strong>Lucas Taboada<\/strong>, proh\u00edbe durante seis meses a una de las principales empresas de comunicaci\u00f3n de Tucum\u00e1n y a su personal emitir\u00a0<strong>contenidos que desacrediten o cuestionen la labor de fiscales y jueces provinciales<\/strong>. El fallo advierte que cualquier incumplimiento ser\u00e1 sancionado por \u00abdesobediencia judicial\u00bb.<\/p>\n<p>La sentencia, fechada el 4 de noviembre, responde a una denuncia presentada por el ministro fiscal de la Corte Suprema Provincial,\u00a0<strong>Edmundo Jes\u00fas Jim\u00e9nez<\/strong>, contra\u00a0<strong>Gustavo An\u00edbal Gabriel Olarte<\/strong>, director y presidente de CCC. Se lo acusa de \u201c<strong>entorpecer y ofender el ejercicio de funciones p\u00fablicas<\/strong>, ejercer coacci\u00f3n institucional e\u00a0<strong>incitar a la violencia o al descr\u00e9dito instituciona<\/strong>l\u201d a trav\u00e9s de su labor period\u00edstica.<\/p>\n<p>El conflicto de fondo surge por el malestar del jefe de los fiscales tucumanos, luego de que en distintas entrevistas y programas emitidos por\u00a0<em>CCC<\/em>\u00a0se cuestionara el desempe\u00f1o de los fiscales alineados con Jim\u00e9nez en \u00abcausas de alto perfil p\u00fablico\u00bb. Seg\u00fan la sentencia, el propietario del medio de comunicaci\u00f3n habr\u00eda \u00abllevado a cabo una\u00a0<strong>campa\u00f1a p\u00fablica de hostigamiento y ataque medi\u00e1tico contra distintos fiscales<\/strong>\u201d.<\/p>\n<p>El texto agrega que en<em>\u00a0CCC<\/em>\u00a0se\u00a0<strong>compartir\u00edan \u201cexpresiones tendenciosas, descontextualizadas y maliciosas\u201d<\/strong>\u00a0con la intenci\u00f3n de distorsionar hechos investigados y el objetivo de<strong>\u00a0\u201csocavar la confianza p\u00fablica<\/strong>\u00a0en la administraci\u00f3n de justicia\u201d.<\/p>\n<p>El gobernador de Tucum\u00e1n,\u00a0<strong>Osvaldo Jaldo<\/strong>, al ser consultado sobre la controversial resoluci\u00f3n, respondi\u00f3 ante la prensa: \u201cSon decisiones de tipo judicial que est\u00e1n en el \u00e1mbito de otro poder.\u00a0<strong>Por lo tanto, yo, como gobernador, soy respetuoso de las decisiones<\/strong>\u201d.<\/p>\n<p>Adem\u00e1s, consider\u00f3 que \u201c<strong>hay caminos judiciales para revertir esa medida<\/strong>, si es que alguien entiende que es injusta o que tiende a amordazar la libertad de prensa. Tienen la v\u00eda judicial. Y esto es lo bueno que tiene la democracia y que hoy los poderes del Estado est\u00e9n funcionando a pleno\u201d, remarc\u00f3.<\/p>\n<p>En paralelo, el Foro de Periodismo Argentino (Fopea) cuestion\u00f3 la medida y\u00a0<strong>plante\u00f3 que \u201cafecta claramente el derecho a la informaci\u00f3n de la ciudadan\u00eda\u201d<\/strong>, y su aplicaci\u00f3n \u201cpondr\u00eda en riesgo la libertad de expresi\u00f3n y de prensa, derechos de raigambre constitucional, adem\u00e1s de representar un claro acto de censura previa\u201d.<\/p>\n<p>Por su parte la\u00a0<em>APT<\/em>\u00a0se\u00f1al\u00f3 en un comunicado: \u201cLa Constituci\u00f3n Argentina en su art. 14 y la Convenci\u00f3n Americana sobre Derechos Humanos en el art. 13 son contundentes al prohibir toda clase de censura previa directa o indirecta como garant\u00eda de la libertad de buscar, recibir y difundir informaciones e ideas de toda \u00edndole. Esta garant\u00eda se refuerza cuando se trata de asuntos de inter\u00e9s p\u00fablico y funcionarios p\u00fablicos\u201d.<\/p>\n<p>Y concluye: \u201cPor dicho motivo, no es viable ninguna clase de censura previa legislativa, administrativa o judicial.
