La Confederaci\u00f3n Argentina de la Mediana Empresa (CAME), la Sociedad Rural Argentina (SRA) y la Confederaci\u00f3n Intercooperativa Agropecuaria (CONINAGRO) se presentaron ayer \u2212en tiempo y forma\u2212 ante la Corte Suprema de Justicia de la Naci\u00f3n (CSJN) como amicus curiae en apoyo al T\u00edtulo IV Trabajo del DNU 70\/2023 \u201cBases para la reconstrucci\u00f3n de la econom\u00eda argentina\u201d.<\/span><\/p>\n<p><span lang=\"ES\">A partir de la declaraci\u00f3n de inconstitucionalidad del T\u00edtulo IV (art\u00edculos 53 a 97) del DNU por parte de la C\u00e1mara Nacional de Apelaciones del Trabajo, y encontr\u00e1ndose en estudio por parte de la CSJN, las tres entidades empresarias expresan la necesidad de derogar todos los art\u00edculos que contemplan multas econ\u00f3micas y que son los principales generadores de la litigiosidad laboral en la Rep\u00fablica Argentina (art\u00edculos 8, 9, 10 y 15 de la Ley 24.013; 1 y 2 de la Ley 25.323; y 80 de la Ley 20.744, conforme el texto ordenado por la Ley 25.345).<\/span><\/p>\n<p><span lang=\"ES\">Los art\u00edculos detallados dificultan la generaci\u00f3n de empleo genuino, al enfrentar a las pymes con la contingencia de afrontar una erogaci\u00f3n que el propio negocio es incapaz de generar. Las multas econ\u00f3micas aludidas provocan una afectaci\u00f3n econ\u00f3mica de enorme relevancia, comprometiendo seria, injusta y desproporcionadamente a las empresas y a la sociedad en su conjunto.<\/span><\/p>\n<p><span lang=\"ES\">Medularmente se expuso que las multas de las leyes 24.013, 25.323 y 25.345 fueron el peor error de pol\u00edtica legislativa en materia social y econ\u00f3mica de la historia del derecho del trabajo en la Argentina, en tanto disuaden a los empleadores de contratar de un modo muy trascendente.<\/span><\/p>\n<p><span lang=\"ES\">La opini\u00f3n y la colaboraci\u00f3n manifestadas por SRA, CAME y CONINAGRO es \u00fanicamente relativa a la parte del derecho individual del trabajo, excluyendo de forma expresa toda vinculaci\u00f3n con el Derecho Colectivo del Trabajo.
