Se trata de Santiago Emiliano Molina y Sergio Mat\u00edas Maciel quienes estaban en el m\u00f3vil policial cuando atropellaron a Andr\u00e9s Bartlett, el joven que muri\u00f3 en Goya el domingo pasado.<\/p>\n<p>Ayer, en la Oficina Judicial de Goya la audiencia de medida de coerci\u00f3n donde el juez de Garant\u00edas, doctor Dar\u00edo Ort\u00edz hizo lugar al pedido de prisi\u00f3n preventiva de los dos polic\u00edas, Santiago Emiliano Molina y Sergio Mat\u00edas Maciel solicitado por la fiscal doctora Mar\u00eda Eugenia Ballar\u00e1 quien los imput\u00f3 por HOMICIDIO AGRAVADO, por el crimen del joven de 37 a\u00f1os Andr\u00e9s Bartlett sucedido el domingo en esa localidad.<\/p>\n<p>La audiencia dur\u00f3 dos horas y la parte querellante se sum\u00f3 al pedido del Ministerio P\u00fablico Fiscal.<\/p>\n<p>La prisi\u00f3n preventiva la decidi\u00f3 el juez por tiempo indeterminado seg\u00fan lo establecen los art\u00edculos 237 y 242 del C\u00f3digo Procesal Penal.<\/p>\n<p>De la audiencia participaron los padres y hermanos de la v\u00edctima, los dos polic\u00edas que en ese momento estaban demorados administrativamente y ahora est\u00e1n detenidos y alojados en Corrientes lo hicieron v\u00eda remota y tres abogados defensores.<\/p>\n<p>El juez Ort\u00edz explic\u00f3 que decret\u00f3 la prisi\u00f3n preventiva porque \u201cse dan los dos riesgos procesales que son el de peligro de fuga y entorpecimiento de la investigaci\u00f3n\u201d, indic\u00f3 el magistrado.<\/p>\n<p>La defensa no discuti\u00f3 la materialidad del hecho y la posible participaci\u00f3n de los imputados en el mismo por lo que el juez solo eval\u00fao los riesgos procesales y tom\u00f3 esa decisi\u00f3n.<\/p>\n<p><strong>LUGAR DE DETENCI\u00d3N<\/strong><\/p>\n<p>La Resoluci\u00f3n por la que se hizo lugar a la prisi\u00f3n preventiva es la N\u00b0 896\/24 donde se decidi\u00f3 la inmediata detenci\u00f3n de los imputados que continuar\u00e1n alojados en su actual lugar de alojamiento, sito en Direcci\u00f3n General de Lucha Contra el Fuego de Corrientes Capital.<\/p>\n<p><strong>LOS FUNDAMENTOS DEL JUEZ<\/strong><\/p>\n<p>El doctor Ort\u00edz afirm\u00f3 en la resoluci\u00f3n que \u201cestimo que existen suficientes indicios como para tener por configurado los riesgos procesales de fuga y de obstaculizaci\u00f3n de la investigaci\u00f3n, teniendo presente para ello el contexto en que sucedi\u00f3 un hecho de suma gravedad, la expectativa de pena de prisi\u00f3n perpetua, la circunstancia de ser funcionarios policiales, los indicios que se mencionaron en cuanto a conductas obstaculizadoras como ser falsear el hecho en la comunicaci\u00f3n a la se\u00f1ora fiscal, la concurrencia al domicilio de testigos, la prohibici\u00f3n de filmar o que trascienda dicha filmaci\u00f3n, todo lo cual se analiza de manera conjunta y concatenada\u201d, indic\u00f3 para justificar su decisi\u00f3n.<\/p><\/div>\n<div><\/div>\n<\/div>\n<div><strong>Momarandu.com<\/strong><\/div>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>GOYA.
